Main components of Conveyancing

Pre-Contract

The seller’s solicitor prepares a draft contract of sale. The seller’s solicitor submits the contract to the seller’s selling agent who markets the property.

Exchange of Contracts

The seller and buyer then meet with their solicitors and sign the contract of sale. The parties exchange their signed counterpart contracts duly signed.

Disclosure of Adverse Matters

The seller must continue to declare all matters adverse to the property that could affect the purchasing decision.

Cooling Off

A contract of sale includes a cooling-off provision usually lasting five business days for existing properties after signing. The parties may waive or shorten the cooling-off period.

Pre Settlement Inspection

A buyer may make a property inspection, usually within the three days before completion and discussed through the selling agent.

Settlement

The new mortgagee registers the transaction to make it official. The parties then sign the transfer and title deed documents to complete the transaction.
